    A divorce proceeding, either as a Plaintiff or Defendant, is a trying and emotional time. You must have an attorney you trust to analyze the particular facts of your case and advise you of all options, including how those options could effect future modification proceedings.

    While a Final Order is issued in a divorce, if there are minor children, that order may be modified if there is a material change in circumstances.  A divorce may be modified until the youngest child reaches the age of majority (19 in the State of Alabama). Divorce modifications can include:
    • custody
    • visitation rights 
    • child support

    There are many child custody cases in which the parents were never married.  In such cases, paternity will need to be established. This also includes child dependency cases where a child is  in need of the Court's intervention for a variety of reasons (in some instances, but not always, the case may involve the Department of Human Resources).
